Official Rules and Regulations
- NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
- How to Enter: Visit http://www.weatherguard.com/toughtruck and follow the links and instructions to complete the registration. Complete and submit the registration. You will automatically receive one (1) entry into the Sweepstakes. Sweepstakes runs May 27, 2008 through November 30, 2008
- For All Entries: Limit one (1) Sweepstakes entry per person, per email address, per week. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.
- The chances of winning are dependent on the total number of entries received.
- Sweepstakes is open only to legal residents of 48 contiguous U.S. states (Alaska & Hawaii excluded) who are at least eighteen (18) years old at the time of entry. Participants must be residing in the contiguous U.S and must be a U.S. licensed driver.
- One (1) grand prize shall be awarded. The grand prize is one (1) 2008 MY, 4x2 Double Cab Tundra Grade Long Bed (4.7L V8) – Model #8243 with a Manufacturer’s Suggested Retail Price of $25,790. Upon the Grand Prize Winner’s completion of the required paperwork & taking delivery of the Tundra, as set forth below, the Grand Prize Winner shall be provided with a Promoter gift certificate. This gift certificate permits the Grand Prize Winner to receive from a Promoter authorized dealer, installation of the following WEATHER GUARD Equipment (1) Aluminum Saddle Box - Model # 127-0-01, (2) Aluminum Lo-Side Box - Model # 174-0-01, (1) ATR Ladder Rack - Model # 1200, and (1) Accessory Side Rails - Model # 1210. This upfit package has a suggested price of $2,731.00 WEATHER GUARD equipment is not a Genuine Toyota accessory. It is warranted and installed by WEATHER GUARD, who is responsible for the installation. Toyota reserves the right to substitute prizes of equal or greater value. Actual grand prize awarded may differ from vehicle shown in any materials promoting the Sweepstakes.
- The winner of the Grand Prize will be determined in a random drawing from all legitimate entries received throughout the sweepstakes on or about December 31, 2008 by Promoter whose selection will be final in all matters relating to this sweepstakes. By entering, all entrants agree to abide by and be bound by these rules and the judges’ decisions, which are final and binding in all matters. By participating in the sweepstakes, entrants waive any right to claim ambiguity in the sweepstakes or in these official rules. Entrants who win a monthly prize remain eligible for the grand prize but are no longer eligible for future monthly prize drawings.
- Prizes are non-transferable, and no substitutions on any prizes (except that Knaack L.L.C. ("Promoter") and Toyota reserve the right to substitute prizes of equal or greater value).
- The winner may not be an employee of Promoter, Toyota Motor Sales, U.S.A., Inc. ("TMS"), those entities' advertising agencies, or any of the aforementioned entities' affiliates or subsidiaries, nor an individual domiciled with any such employee;
- TMS and Promoter shall not have any responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with the prizes provided pursuant to the Sweepstakes and/or any person’s participation in the Sweepstakes; provided, however, that TMS shall be solely responsible for any express written limited warranties specifically set forth in the applicable Owner's Guide for the Prize Vehicle (but not for any aftermarket parts and/or accessories and/or modifications to the Vehicle by or on behalf of the Promoter). Non-factory installed modifications and/or accessories may void the manufacturer’s express written limited warranties and/or may render the vehicle not street legal, and have not been undertaken by TMS.
- The depiction of the Prize Vehicle in any advertising or promotional materials may not reflect the actual vehicle delivered to the winner.
- The Sweepstakes shall be staged in compliance with all applicable federal, state and local laws.
- The Sweepstakes shall be void in Hawaii and where prohibited or restricted by law.
- The winner (and if the winner is a minor in his/her jurisdiction of residence, his/her parent or legal guardian) shall be required to execute and notarize an affidavit of eligibility and liability/publicity release and return such affidavit to the Promoter within 2 weeks of being notified as "prize winner" or an alternative winner shall be selected in a random drawing from among all eligible entries received. Only three (3) alternate drawings will be held after which the prize will remain unawarded.
- The winner shall be responsible for all taxes, license, title and registration fees or other costs, including without limitation any travel or transportation costs, associated with transferring and/or winning of the Prize Vehicle (provided, however, the Prize Vehicle shall be delivered at no cost to the winner at an authorized Toyota dealer in the continental U.S. reasonably close in proximity to the winner's residence).
- TMS shall not be responsible for delays in delivery of the Prize Vehicle, and delivery is subject to availability. TMS, however, shall use all reasonable efforts, subject to availability, to deliver the Prize Vehicle within one-hundred fifty (150) days after receipt of the aforementioned items/information. The winner shall bear all risk of loss or damage to the Prize Vehicle after it has been delivered to the specified delivery site. The winner must personally retrieve the Prize Vehicle within thirty (30) days of written notification of delivery and must present adequate personal identification and evidence of legally required insurance (or an alternative winner shall be selected and the original winner’s rights to the Prize Vehicle shall be automatically forfeited).
- The Prize Vehicle will be delivered solely with the express written limited warranties set forth in the Prize Vehicle's applicable Owner's Guide, which warranties shall run for the term set forth in said Guide. The vehicle, however, shall contain aftermarket parts and accessories, as well as special features applied by or on behalf of Promoter, which are not covered under, and may void, limit and/or adversely impact, the Vehicle's express written limited warranties.
- TMS and Promoter shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or irregularity arising out of or relating to any prize granted under this sweepstakes, even if caused by the negligence of TMS and Promoter, except that the terms of TMS' liability to the winners of the Prize Vehicle will be governed by the express written limited warranties set forth in the Prize Vehicle's applicable Owner's Guide.
- Acceptance of a prize constitutes permission to the extent permitted by law in the jurisdiction for Promoter and TMS and/or their designees to use the winner's name, address, photograph, testimonial or other likeness and/or prize information or personal exposition (and/or any edited portion thereof) for promotional, advertising and/or publicity purposes in any media, now or hereafter known throughout the world in perpetuity, without compensation or notice to, or further consent of the winner, to the extent permitted by law.
- No Prizes can be exchanged for cash.
